This Privacy Statement applies to information collected in connection with WIMO’s online and mobile games and applications, including any content, functionality, discussion forums, products and services offered on or through our games and applications (collectively, “Applications”), as well as any other WIMO products and services that include or link to this Privacy Statement (such other products and services, together with our Applications, are collectively referred to in this Privacy Statement as the “Services”).

Our Services are operated by WIMO in the United States. Any personal data or other information provided to us or obtained through your use of our Services will result in the collection, storage, and processing of such information in the United States. As a result, if you are using our Services from a country other than the United States, your personal data will cross an international boundary. The level of protection for your personal data in the United States may not be the same as the level of protection in your country.

WIMO’s Supplemental Privacy Statement for California Residents supplements the information contained in this Privacy Statement and applies solely to visitors, users, and others who reside in the State of California.


Information Collection and Use

WIMO collects information that can be used to identify or contact a particular person (we refer to this type of data as “personal data”). Personal data may also include information that does not directly identify you by name or include your contact information, but which may be used to identify a specific computer or device that has accessed our Services and if combined with certain other information, could be used to identify a particular person.


WIMO collects and processes personal data that you choose to share with us, as well as information generated through or in connection with your use of the Services. This information may include:

  • Information you provide to us when purchasing or otherwise obtaining Services, creating an account with us, using the Services, contacting us, submitting an inquiry, responding to our surveys or promotional offers, participating in chat forums, signing up for our email alerts or subscribing to other communications from us, registering for and participating in contents and special events, and otherwise responding to our requests. This information includes your name, username, physical address, email address, telephone number, date of birth, gender, payment information, chat forum posts, survey responses, preferences selected, and other information you provide to us.
  • Information regarding your purchases, access to and use of the Services, and other transactions relating to the Services and activities carried out through the Services. This information includes purchase history, transaction dates, in-game progress, records of virtual items and virtual currencies obtained through the Services, records of communications with customer support and other WIMO personnel.
  • Information obtained from third parties, such as our advertising partners, service providers, payment processors, social media platforms, public databases and data aggregators, and third-party app stores (e.g., Google Play and the Apple App Store). This information may include your name, demographic information, interests, and publicly-observed data such as from social media and shopping behavior.


We use this information for the purpose you provided it, such as to provide the Services to you, create your account, administer and maintain your account, process your payments, respond to your inquiries, and send you requested communications. We also use your information for other legitimate business purposes, including the following:

  • To maintain the safety, security, and integrity of our Services.
  • To engage in direct marketing activities, including to personalize your experience with our Services and to deliver content and product offerings relevant to your interests, including targeted offers and ads through our Services, third-party websites and games, and email and text messages.
  • To send important notices, such as communications about purchases and changes to our terms, conditions, and policies. Because this information is important to your interaction with WIMO, you generally may not opt out of receiving these communications.
  • Internal administrative purposes, such as auditing, data analysis, and research to improve our products, services, and customer communications. This includes processing for purposes of statistical analysis.
  • When we have a legal obligation to collect, use and share your information, and for legal proceedings and government investigations (such as pursuant to warrants, subpoenas, and court legal orders).
  • Internal investigations of possible misconduct or failure to comply with our policies and procedures.
  • Any other purpose described to you before or at the time your information is collected.


In addition to the personal data described above, we collect certain device and usage data generated automatically when you download, access, visit, use, or otherwise interact with our Services (“Usage Data”). Usage Data includes your IP address, Internet service provider, browser type and settings, device information (e.g., type of device, operating system, device manufacturer, MAC address), referring/exiting URL, Service request/response date and time, “clickstream” data (which reflects activities on our Services such as the features you visit and in what order), mobile device ID or mobile advertising ID, geolocation data, and social network account information.


We use common tools and technologies to collect Usage Data, including cookies, web beacons (also known as pixel tags or clear GIFs), software development kits, server logs, statistical identifiers, and similar tools (collectively, “cookies and similar technologies”). A “cookie” is a unique numeric code that is transferred to your computer or device to track your interests and preferences and to recognize you as a return visitor. A “web beacon” is a transparent graphic image placed on a website that enables the monitoring of things such as user activity and site traffic by our third-party partners and service providers. “Software development kits” (also called SDKs) function like third-party cookies and web beacons, but operate in the mobile app environment where cookies and web beacons cannot function as effectively. “Statistical identifiers” refer to identifiers created using certain device information and identifiers that makes your browser or device sufficiently distinct for a server or similar system to reasonably determine that it is encountering the same browser or device over time.

EUROPEAN RESIDENTS: We collect and process your personal data for the uses and purposes described above and elsewhere in this Privacy Statement. The relevant legal bases under European law for collecting and processing your personal data as described in this Privacy Statement include the following:

  • Your consent: In some cases, at the point at which you provide personal data, we may ask you for your consent to collect and process such data. If you provide us with your consent, you may later withdraw your consent (or opt-out) by contacting us at the information provided under the Contact Us section below. If you withdraw your consent it will not affect any processing of your personal data that has already occurred. Where we process your personal data based on consent, we will provide more detailed information to you at the time when we obtain your consent.
  • Compliance with applicable laws or performance of a contract: In specific circumstances, we may need to process your personal data to comply with relevant laws and regulations and/or to fulfill our obligations under a contract with you. Where we process your personal data to meet our legal obligations, you will likely not be permitted to object to this processing activity, but you will usually have the right to access or review this information unless it would impede our legal obligations. Where we are processing your personal data to fulfill our obligations under a contract with you, you might not be able to object to this processing, or if you do choose to opt-out or object to our processing, it may impact our ability to perform a contractual obligation that you are owed, such as access to the Services.
  • WIMO’s legitimate interests: In many instances, we may collect and process your personal data for our own legitimate business purposes, including to guarantee the stability and security of our Services; to improve your experience while using our Services; to promote our products and services; to provide customer support; to provide, manage and optimize our products and services; to develop new products and services; and to better understand users and their preferences, and measure and manage the frequency of our ads.

Information Collected by Our Advertising Partners

We use third-party advertising partners to provide audience measurement and analytics services, to serve ads on our behalf on our Services and on third-party sites and apps, and to track and report on the performance of our ads. To provide their services, these advertising networks and partners use cookies and similar technologies to collect your Usage Data and other information. Some of these advertisers and ad networks may also use anonymous data, such as demographic data, received from third parties to assist in the delivery of advertisements to you. These advertisers and ad networks use this information to provide you relevant advertisements based on your online behavior, including activities on our Services and on other third party sites and apps. This information is also used for campaign performance tracking and player engagement with in-game ad tracking.


For example, we may use third-party cookies and similar technologies to deliver our ads on third-party websites through a common form of online advertising known as “retargeting.” Retargeting works by serving ads on one website based on an individual’s activities on a different website. To do this, we allow our advertising partners to deploy their own third-party cookies and similar technologies when users visit our online games, allowing these ad partners to recognize users who have previously visited our online games. When these users visit a third-party website that includes features provided by our ad partners (e.g., where our ad partners have purchased ad space), our ad partners can recognize the users’ interest in our products and services and deliver one of our ads on the third-party website.

DO NOT TRACK SIGNALS: There are different ways you can prevent tracking of your online activity. One of them is setting a preference in your browser that alerts websites you visit that you do not want them to collect certain information about you. This is referred to as a Do-Not-Track (“DNT”) signal. Please note that currently our Services do not respond to these signals from web browsers. At this time, there is no universally accepted standard for what a company should do when a DNT signal is detected.

Sign-In Services | Interacting with Social Media 

Our Services may allow you to log in using sign-in services such as Facebook Connect, Apple’s Game Center, Google Play, Google +, Amazon, or an Open ID provider. These services will authenticate your identity and may provide you the option to share certain personal data with us such as your name, e-mail address, and photo to pre-populate forms on our Services. Once your identity has been authenticated, we may collect certain additional information such as the sign-in service used and a unique identification code associated with the sign-on service.


Our Services may also contain functionality which enables you to import profile information or contacts from third party social media services that you use (collectively, “Third Party Social Media Accounts”). If you choose to do this, you may have to log into your applicable Third Party Social Media Account using your Third Party Social Media Account user name and password. The copy of the information received by us shall be subject to this Privacy Statement. However, any data maintained in your Third Party Social Media Account and your use of the applicable social media platform will be subject to the platform’s terms of use and privacy policy.


You may have the ability to share information from our Services to your Third Party Social Media Accounts (including by taking advantages of features such as the Facebook “like” button or “Share to Twitter” button appearing on our Services). Services that allow you to do this use social plugins (e.g., the Facebook “Like” button) to enable you to easily share information with others. When you visit our Services, the operator of the social plugin can place a cookie on your computer, enabling that operator to recognize individuals who have previously visited our Services. If you are logged into your Third Party Social Media Account (e.g., Facebook) while interacting with our Services, the social plugins allow applicable social media platforms to receive information regarding your interactions with our Services. The social plugins also allow social media websites to share information about your activities on our Services with other users of the applicable social media platform. For example, Facebook Social Plugins may allow Facebook to show your Likes and comments on our Services to your Facebook friends. WIMO does not control any of the content from the social media plugins, but we do receive aggregated statistics, e-mail addresses, and profile information.

Information Disclosure and Sharing

WIMO will not sell or rent your personal data. Further, we will not disclose your personal data to any third party outside of our organization, except with our affiliates and as described below.

  • Service Providers. In the course of doing business, we employ other companies and individuals to perform a variety of functions on our behalf. For example, we may provide your information to companies that host our Services or process credit card information. These service providers may have access to personal data about you if it is needed to perform their functions for us, but they are not authorized by WIMO to use or disclose the information except as necessary to perform services on our behalf or to comply with legal requirements, and they are required to maintain the information in confidence.
  • Social Media Platforms. You may have the ability to share information from our Services with your Third Party Social Media Accounts.
  • Advertising Partners. Services we use to market WIMO to you on sites and apps other than our Services. Please see the Information Collected by Our Advertising Partners section above for more information, including information on how to opt-out from the use of these ad services.
  • Legal Obligations.We reserve the right to disclose information if we believe that disclosure is reasonably necessary to comply with a law, regulation or legal request; to protect the safety, rights, or property of the public, any person, or WIMO; to detect, prevent, or otherwise address fraud, security or technical issues; or to detect, prevent, or enforce violations of this Privacy Statement or our Terms of Use.
  • Sale or Bankruptcy. During the normal course of our business, WIMO may sell or purchase assets. If another entity acquires us or any of our assets, information we have collected about you may be transferred to such entity. In addition, if any bankruptcy or reorganization proceeding is brought by or against us, such information may be considered an asset of ours and may be sold or transferred to third parties. Should a sale or transfer occur, we will use reasonable efforts to try to require that the transferee use personal data provided through our Services in a manner that is consistent with this Privacy Statement.

  • You may choose not to provide any personal data to WIMO by electing not to enter any personal data into a form or data field on our Services, and by not using any personalized Services provided by our Services. However, many of our Services are available only to individuals who provide certain information.
  • You may contact us at the information provided under the Contact Us section below to request access to review, correct or delete any personal data maintained on our systems provided to us in response to the Services registration process or other WIMO request. To protect your privacy, we will respond only to e-mail messages sent from the e-mail account that you specified during the account registration process.
  • You may opt out from receiving our newsletters and other promotional emails from WIMO by notifying us at the information provided under the Contact Us section below.

Your Privacy Rights

You have various rights with respect to the collection, use, transfer and processing of your personal data, as described below. Access Right 

You have the right to obtain confirmation as to whether or not your personal data is being processed by WIMO. Where we are processing your personal data, you have the right to access the data and to obtain certain information about the processing of such data.


Right to Rectification 

You have the right to obtain rectification of any personal data that is inaccurate or incomplete, including by means of providing a supplementary statement, subject to any limitations or exceptions under applicable law.


Right to Erasure 

You have the right to have your personal data erased in certain circumstances, subject to any limitations or exceptions under applicable law.


Right to Restriction of Processing 

If you reside in the European Union or U.K. (or if otherwise required under applicable law), you have the right to restrict the processing of your personal data where one of the following applies:

  • The accuracy of the personal data is contested.
  • The processing is unlawful and you oppose the erasure of your personal data and request the restriction of its use instead.
  • WIMO no longer needs the personal data for the purposes of the processing, but it is required by you for the establishment, exercise or defense of legal claims.

Right to Object 

If you reside in the European Union or U.K. (or if otherwise required under applicable law), you have the right to object (on grounds relating to your particular situation) at any time to the processing of your personal data for direct marketing purposes or where the processing is based on WIMO’s (or a third party’s) legitimate interest. When objecting to processing based on our legitimate interest, WIMO will no longer process your personal data unless WIMO demonstrates compelling legitimate grounds for the processing which override your interests, rights and freedoms or for the establishment, exercise, or defense of legal claims.


Right to Withdraw Consent 

Where the processing of your personal data is based on your consent, you have the right to withdraw such consent at any time, without affecting the lawfulness of processing based on consent before such withdrawal.


Right to Data Portability 

If you reside in the European Union or U.K. (or if otherwise required under applicable law), you have the right to receive your personal data, which you have provided to WIMO, in a structured, commonly used and machine-readable format, and have the right to transmit such data to another entity without hindrance from WIMO, subject to any limitations or exceptions under applicable law.


Right Not to Be Subject to Solely Automated Decisions 

If you reside in the European Union or U.K. (or if otherwise required under applicable law), you have the right not to be subject to a decision based solely on automated processing (including profiling) which produces legal effects concerning you or similarly significantly affects you, unless permitted under applicable law.


Right to Submit a Complaint to Supervisory Authorities 

If you reside in the European Union or U.K. (or if otherwise required under applicable law), you have the right to lodge a complaint with an applicable data protection authority. If you reside in Europe or U.K., you have the right to lodge such a compliant in the country of your habitual residence, place of work, or place of an alleged infringement if you consider that the processing of your personal data infringes applicable European data protection laws. Public Forums

Our Services may include forums, chat functionality or other features where you can exchange information or otherwise interact with other users of our Services. When you do so, you understand that all information transmitted will be made available to and accessible by WIMO and other users of our Services. You have no expectation of privacy in connection with such communications. WIMO is not responsible for whether or how such third parties utilize the information you post or share through such features.

Security

WIMO takes reasonable steps to protect your personal data, according to its sensitivity, as it is collected and transmitted between your computer or device and our Services and servers, as well as to protect your personal data in our possession from unauthorized access, disclosure, alteration or destruction. It is your personal responsibility to secure your own copies of your passwords and related access codes used to access our Services.

Data Retention

We generally retain personal data for as long as needed for the specific business purpose or purposes for which it was collected. In some cases, we may be required to retain information for a longer period of time based on laws or regulations that apply to our business or for other necessary business purposes. Where possible, we aim to anonymize the information or remove unnecessary identifiers from records that we may need to keep for periods beyond the original retention period.

General Audience Services

Our Services are intended for general audiences and we do not knowingly collect any personal data from children under the age of 13 (in the United States) or 16 (in Europe) on our Services.

SUPPLEMENTAL PRIVACY STATEMENT FOR CALIFORNIA RESIDENTS

This Supplemental Privacy Statement for California Residents (“California Privacy Statement”) provides additional information required under the California Consumer Privacy Protection Act (CCPA) regarding the personal information we collect from and about California residents, and describes the rights granted to California residents under the CCPA.

This California Privacy Statement applies to information collected from or about California residents only. This California Privacy Statement applies to any and all personal information about California residents collected by WIMO, including personal information collected in connection with our Services, as well as personal information collected offline.


Definitions Specific to California Privacy Statement

The CCPA includes definitions for terms specific to this California Privacy Statement that do not apply to WIMO’s other privacy notices, including the following terms:

“Personal information” (regardless of whether such term is capitalized or not) means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household. Personal information does not include publicly available information obtained from government records or deidentified or aggregated consumer information.


“Sell,” “selling,” “sale,” or “sold” (regardless of whether such terms are capitalized or not) means selling, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or by electronic or other means, a consumer’s personal information by the business to another business or a Third Party for monetary or other valuable consideration.


“Service Provider” means certain for-profit legal entities that process information on behalf of WIMO and to which we disclose your personal information for a defined business purpose pursuant to a written contract that prohibits this service provider from retaining, using, or disclosing your personal information for any purpose other than for the specific purpose of performing the services specified in the contract with us. 


“Third Party” means another business that collects or receives your personal information, other than a Service Provider.


All other capitalized terms used but not defined in this California Privacy Statement shall have the meanings ascribed in our Privacy Statement.

  

Personal Information Collection and Use

WIMO has collected the following categories of personal information about California consumers in the preceding twelve (12) months:

  • Identifiers and contact information, including full name, player/user ID, postal address, telephone number, email address, date of birth, account name, IP address, online identifier, social network or platform account username/handle, device ID, and mobile advertising ID.
  • Commercial information, including games played, in-app purchases and other products and services purchased, survey responses, content posted on      forums and discussion boards, Services preferences, in-game activities, character development and character interaction, and other purchasing and consuming histories and tendencies.
  • Financial information, including credit or debit card number and payment amounts.
  • Internet activity information, such as log data, browsing history, cookie data, referring/exiting URL, clickstream data, time spent on our Services, and other information regarding user interaction with our Services, other websites and apps, emails, and advertisements.
  • Geolocation data, including approximate or precise device location.
  • Physical/demographic information, such as age (or age group) and gender.
  • Photographs, such as a player/user profile photo.
  • Written signature, such as a signature on a parental consent form.
  • Inferences drawn from any of the information listed above to create a profile about a California consumer reflecting the individual’s preferences, characteristics, behavior, or abilities.

Request Verification

We value the security and confidentiality of your personal information.
